Legal Division

The basic function of the Legal Division is to furnish legal advice to the Divisions of the Ministry of External Affairs and other Ministries, Sri Lanka Missions abroad and Foreign Missions in Sri Lanka. It also furnishes information of a legal nature to foreign Governments, the UNO and other International Organizations and Agencies and handle bilateral negotiations, prepare agreements for signature and take steps for ratify agreements.

  

KEY ACTIVITIES

 

Providing Legal Advice

 

On policy decisions and international issues, territorial claims and boundaries, recognition of treaty relations and diplomatic immunities and privileges etc., and on matters of

International Law to other Ministries and Government Departments involved in foreign transactions covering a wide range of subjects such as Shipping, Civil Aviation, International Trade and Investment, Extradition, Mutual Legal Assistance, Double Taxation, Investment Protection and Promotion, Transfer of Prisoners, International Claims and Law of the Sea etc.

 

Negotiation of Bilateral, Regional and Multilateral Treaties

 

Takes initiative in convening, holding, negotiating and finalizing treaties on areas such as

Judicial Cooperation, Extradition, Mutual Legal Assistance on Criminal, Civil and Commercial matters, Avoidance of Double Taxation, Investment Protection and Promotion, Transfer of Prisoners, Readmission of Persons, Migration, Civil Aviation, Labour and Manpower and Law of the Sea, all types of general agreements including, cultural cooperation, Agriculture,

Joint cooperation, Trade, Scientific and Technical Cooperation Agreements,

 

Serving Judicial Documents

 

Serving of Judicial Documents such as Summons and Decrees issued by Courts to persons living abroad and serving of Summons and Decrees issued by Foreign Courts on Sri Lanka citizens are facilitated by Legal Division.

 

Furnishing Information

 

Furnish information of a legal nature to foreign Governments, the UNO and other International Organizations and Agencies.

 

Treaty Index

 

Maintain Sri Lanka’s Treaty Index containing all Bilateral, Regional and Multilateral Agreements/MoUs signed by Sri Lanka.

 

Preparation of Instrument of Full Powers

 

In terms of Article 7 of the Vienna Convention on the Law of Treaties, Instrument of Full Powers are prepared by the Legal Division authorizing accredited representatives of the Government of Sri Lanka to sign Agreements /MoUs with foreign Governments and international organizations.

 

This division is currently headed by the Legal Advisor, Mr. Thushantha Wijemanna.
